Overcriminalization of business

This NYT article describes the problems with overcriminalization.  Problems like being prosecuted for actions that you had no reasonable reason to believe were illegal.

In a corporatist world all of the various interest groups are in a cold war with each other to gain power and wealth.   Overcriminalization is one way that the uberstate maintains control and primacy.  I'll bet you Federal Pariahs like the 'Koch Brothers' are getting a lot more scrutiny than its pets like Warren Buffet.  Which is why there are so very few business leaders willing to openly challenge the Federal superstate.

And as the superstate's coercive regulatory plaque builds up, the economy slowly but surely runs down.  Slower and slower, weaker and weaker until it chokes to death.  State parasitism is a fatal disease that we desperately need to find a cure for.
